On 6th October 2014 we reported that there would be a
delay to the introduction of Part 1 of the Anti-Social
Behaviour, Crime and Policing Act 2014 – the civil
injunction – to allow for “unavoidable and necessary
changes” to be made to the Legal Aid, Sentencing
and Punishment of Offenders Act 2012. At the time
the Home Office said this should be completed by the
end of January 2015 at the latest.
It is understood that the latest news from government is that the injunction will not
now commence this month, but that it will definitely commence by the 30th March 2015. It is understood that the further delay is to do with consequential changes to the legal aid remuneration rate which are presently being progressed with providers of legal aid services.
It is further understood that the ability to delegate Community Protection Notice (CPN) powers will also commence on 30th March 2015.
